The model

What is Employer of Record

Employer of Record, usually referred to simply as EOR, is the model in which one company formally becomes the employer of a professional on behalf of another company. In practice, Einfach is the employer under Brazilian law, while the professional works exclusively for the client company, which defines duties, targets and work routine.

In Brazil, an employee must be linked to an employer legally established in the country, responsible for meeting labor, social-security and tax obligations. For foreign companies that do not yet have a subsidiary, this requirement can delay the start of operations. EOR postpones that initial step, allowing professionals to be hired properly from day one.

While Einfach manages the employment relationship and all legal obligations arising from the hire, the client company remains responsible for managing the professional — defining activities, targets, variable pay, vacation scheduling and other work-related decisions.

For this reason, EOR is an especially suitable option for companies that want to start operations in Brazil quickly, hire strategic professionals or validate the market before deciding to set up their own subsidiary.

How our model works

When structuring an EOR, Einfach becomes the employer under Brazilian law. This starts with recruitment and selection, continues through the formal hiring and lasts throughout the entire relationship, with monthly administration of payroll, benefits, vacation, labor and social-security charges, and compliance with the ancillary obligations required by the CLT (Brazilian Labor Code) and regulatory bodies.

When the relationship ends, we also handle the termination: calculation of severance amounts, official ratification where applicable, and the proper closing of the employment relationship before the competent authorities.

What stays with the client company is the management of the work itself: setting targets, assigning activities, performance evaluation, tools used, routine and direct supervision of the professional. Einfach does not interfere in the day-to-day working relationship; our responsibility is to keep that relationship fully compliant with Brazilian law so the client company can focus exclusively on the operation.

Specifics of hiring in Brazil

Some aspects of Brazilian labor law stand out because they have no direct equivalent in other countries. The cost of a professional is not limited to the gross salary. Certain charges add a significant amount on top of the pay and must be factored in from the initial budget of the role.

FGTSA severance guarantee fund deposited monthly into an account linked to the worker, equal to 8% of the salary.
VacationBrazilian law guarantees 30 days of paid vacation per year, plus a constitutional bonus.
13 salaries per yearBrazilian workers receive 13 payments per year. The thirteenth salary is paid between November and December.

Recruitment for roles structured via EOR follows the same rigor we apply to any selection process conducted for our clients.

After receiving the job description, we actively source candidates, prioritizing professionals whose background matches the client company’s standards — not just the literal job description. Selected candidates go through résumé screening and a first interview before being presented.

The final decision on who to hire always rests with the client company.

We present selected professionals matching the required profile within 40 days, and can present candidates as early as the first week.

Ongoing operation

Monthly management

Once the hire is formalized, the operation moves to a monthly rhythm. We process payroll, calculate and pay labor and social-security charges, administer the contracted benefits and keep track of vacation, the thirteenth salary and other ancillary obligations required by law.

The client company bears the cost of the employee and of the monthly management, billed on a monthly basis.

When the time for a subsidiary comes

Many companies begin their presence in Brazil through an EOR: they hire the first professional, validate demand, test the operation for a few months or years, and only then assess whether it makes sense to set up their own structure.

When that moment arrives, the transition is usually simpler than expected, especially when the EOR was run with proper organization from the start. Einfach also coordinates the formation of subsidiaries for foreign companies in Brazil and can manage the team’s transition.
